Developer found to be in breach of planning laws

THE developer behind a controversial apartment complex in Liffey Valley, has allegedly not complied with updated planning conditions, according to South Dublin County Council.

The Larkfield House complex, formerly Liffey Valley Fitness centre, first came to attention in early 2018 when it was discovered it had more units than permitted under planning permission.

At the time, this led to fears that tenants paying rent in Larkfield House were facing eviction, with assistance payments suspended following a planning inspection.

In 2016, SDCC granted permission for 27 apartments at the site – however up to 48 apartments were built by developer Cavvies Ltd.

Cavvies Ltd, whose registered address is the Sheldon Park Hotel on Kylemore Road, was subsequently given permission to retain ten of the additional apartments.

However, SDCC has found that the developer has not complied with a condition of the latest planning permission – which includes a written schedule of works for the redevelopment of the complex.

A planning enforcement investigation is under way and a warning letter has been issued.

It is believed that the building is fully occupied with up to 45 households, scheduled to be scaled down to 37 units.

It is understood a number of families in receipt of HAP (Housing Assistance Payment) from Dublin City Council remain as tenants.
