Judge David McHugh adjourned the case for further consideration of the issue of jurisdiction on a later date.

The 51-year-old man is charged with contravening a safety order taken out by his wife and assaulting her, causing her harm at their home on October 6, 2020.

The charges are contrary to  Section 33 of the Domestic Violence Act and Section 3 of the Non Fatal Offences Against the Person Act.

Sergeant Walter Sweeney said it was alleged the accused breached the order on the day in question and physically assaulted his wife by punching her in the back of the neck and on the face.

The prosecution would also allege that he threw boiling water over her left leg and threatened her that if she went to the gardai he would kill her, the sergeant said.

The man made no admissions when detained and questioned, the court heard.

Sgt Sweeney said the DPP had directed summary disposal of the case if jurisdiction was accepted.

However, the court heard a medical report on the woman’s injuries was not available.

Judge McHugh said he needed to see any medical evidence before he could decide on jurisdiction, particularly in relation to the allegation of boiling water being thrown on the woman’s leg.

Deferring the decision on jurisdiction, he remanded the accused on continuing bail in his absence to a date this month.
